Terms of Use

1.Who operates Retouch Tutor

Retouch Tutor is operated by Exceeders Aprendizagem e Ação Ltda., registered under Brazilian company number (CNPJ) 72.905.987/0001-02, with registered offices at Avenida Brigadeiro Luís Antônio, 3875, Jardim Paulista, CEP 01401-001, São Paulo, SP, Brasil (“we”, “us”).

These Terms govern the use of the retouchtutor.com website and the app.retouchtutor.com application. By creating an account or subscribing to a plan, you confirm that you have read and agree to them. If you do not agree, do not use the service.

2.What Retouch Tutor does — and what it does not

Retouch Tutor analyses images that have already been retouched and returns a technical reading: what works against approval, what to preserve, where to act, and a score per axis. It also generates instruction scripts for generative AI tools and lets you mark up images for approval.

It does not do the following, and this matters:

• It does not retouch images or generate pixels. Execution remains yours, in the tool you already use.
• It does not guarantee that a client, agency, editor or brand will approve your work. Approval involves commercial and subjective criteria that no technical system reaches.
• It does not replace your judgement. The assessment is produced by artificial intelligence models and may contain errors, inaccuracies, or readings you rightly disagree with.

The decision about what to do with the image is always yours, and responsibility for the work delivered to your client remains entirely with you.

3.Your account

• You must be 18 or older and legally able to enter into a contract.
• Registration details must be truthful and kept up to date.
• The account is individual. You are responsible for keeping your password confidential and for everything done with your credentials.
• If you suspect unauthorised use, tell us immediately.

4.Plans, credits and billing

• Plans are auto-renewing subscriptions, monthly or annual, and each includes a quota of assessments per cycle.
• The cycle quota does not roll over: whatever is unused does not carry into the next cycle.
• Subscribers may buy additional credits. Those credits do not expire while the subscription is active.
• Billing is processed by Stripe. Your card details are collected and stored by Stripe — we neither receive nor store them.
• Prices are shown at the time of purchase, in the stated currency, and may change. Price changes do not affect cycles already paid for and will be communicated before taking effect.
• If a charge fails, access may be suspended until the account is brought up to date.

5.Cancellation and refunds

You can cancel your subscription at any time, from your own account. Cancelling stops future renewals and access remains until the end of the cycle already paid for — there is no pro-rata refund of a cycle in progress.

Right of withdrawal. For purchases made online, you have 7 calendar days from the purchase to withdraw and receive a full refund, under article 49 of the Brazilian Consumer Protection Code, which governs this agreement. Just write to contato@retouchtutor.com.

6.What you may and may not do

You may use Retouch Tutor in your own work and your clients’ work:

• Analyse images of your own, or third-party images for clients you serve.
• Export, print and send assessments to clients and teams.
• Use the generated scripts in whichever AI tool you prefer.

You may not:

• Upload illegal content, or content you have no right to use.
• Upload images containing sensitive personal data of third parties without a lawful basis for doing so.
• Share credentials, resell or sublicense access.
• Circumvent quotas and limits, automate use of the interface, scrape content, or reverse engineer the service.
• Use the service’s outputs to train, calibrate or evaluate a competing system.

7.Your images remain yours

You retain all rights over the images, briefings, markups and other materials you upload. Nothing here transfers authorship or ownership to us.

So that the service can work, you grant us a limited, non-exclusive and revocable licence to store, process, transmit to the providers described in section 9, and display that content — only to the extent necessary to provide the service to you. That licence ends when you delete the content or close your account.

By uploading a file, you confirm you have the right to do so, including when the image belongs to a client, agency or brand.

8.What is ours

The software, the assessment methodology, the criteria, the scoring models, the interface, the brand and the texts of Retouch Tutor are ours or licensed to us, and remain protected by copyright and other applicable laws. Nothing in these Terms transfers those rights.

The assessment generated from your images, on the other hand, is yours: you may use it commercially, including with clients.

9.Processing by artificial intelligence providers

To produce the assessment, the images and texts you upload are transmitted to AI model providers — currently Anthropic, OpenAI and Google — through their business interfaces. Without that transmission, the service does not work.

Details of which data is sent, for what purpose and under what conditions are in the Privacy Policy, which forms an integral part of these Terms.

10.Availability and beta stage

Retouch Tutor is in an early stage of operation. Features may be changed, added or discontinued, and there may be planned or unplanned downtime. We will do our best to give advance notice of relevant changes, but we do not guarantee uninterrupted or error-free operation.

11.Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for lost profits, lost contracts, reputational harm, or commercial decisions taken on the basis of an assessment. Our total liability, in any event, is limited to the amount you paid for the service in the 12 months preceding the event.

This section does not set aside the rights granted to you by the Brazilian Consumer Protection Code, where applicable, nor does it exclude liability for wilful misconduct or gross negligence.

12.Suspension and termination

We may suspend or terminate access in case of breach of these Terms, well-founded suspicion of fraud, or non-payment, with notice whenever possible. You may close your account whenever you want.

What happens to your work after cancellation. Assessments, comparisons, projects and images are kept for 90 calendar days from the end of the last paid cycle. If you subscribe again within that window, you find everything where you left it. After that, the content is permanently deleted and cannot be recovered — it is worth exporting what matters before cancelling.

Treatment of other data follows the Privacy Policy.

13.Changes to these Terms

We may update these Terms. When a change is relevant, we will give reasonable advance notice by email or within the application. The effective date at the top of this page always indicates the version in force, and continuing to use the service after it means you accept the new version.

14.Governing law and jurisdiction

These Terms are governed by the laws of Brazil. The courts of São Paulo, SP, Brazil, are elected to settle disputes, without prejudice to a consumer’s right to bring proceedings in the courts of their own domicile.
